Terms of Service

1. Agreement to Terms

By downloading, installing, or using any application developed by A Better App Company ("we," "us," or "our"), including WhatRUHungry4 and FoodSmash (collectively, the "Apps"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, do not use our Apps.

2. Description of Services

WhatRUHungry4

A restaurant discovery application that uses your location to find nearby restaurants and presents them in a spinning wheel format to help you decide where to eat. Restaurant data is provided by Yelp.

FoodSmash

A match-3 puzzle game featuring food-themed levels and characters, including Munchzilla. The game includes in-app purchases for virtual items and ad-free experiences.

3. Eligibility

You must be at least 13 years old to use our Apps. If you are under 18, you represent that you have your parent or guardian's permission to use the Apps. By using our Apps, you represent and warrant that you meet these requirements.

FoodSmash is rated 4+ but still requires users to meet the minimum age requirements for creating accounts or making purchases.

4. Account Registration

Some features may require account registration. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms.

5. In-App Purchases

Virtual Items

Our Apps may offer in-app purchases for virtual items, currency, or features. These purchases:

• Are processed through Apple App Store or Google Play Store
• Are non-refundable except as required by law
• Have no real-world monetary value
• Cannot be transferred or exchanged
• May be modified or discontinued at our discretion

Subscriptions

If applicable, subscriptions will automatically renew unless canceled before the renewal date. You can manage subscriptions through your device's app store settings.

6. User Conduct

When using our Apps, you agree NOT to:

• Violate any applicable laws or regulations
• Attempt to hack, reverse engineer, or modify the Apps
• Use cheats, exploits, automation software, or bots
• Interfere with the operation of the Apps or servers
• Attempt to gain unauthorized access to other users' accounts
• Sell, trade, or transfer your account to others
• Use the Apps for any commercial purpose without permission
• Harass, abuse, or harm other users
• Upload or transmit viruses or malicious code

7. Intellectual Property

Our Rights

All content in our Apps, including but not limited to text, graphics, logos, images, audio, video, software, and game elements (characters, levels, artwork), is owned by A Better App Company or its licensors and is protected by intellectual property laws.

Trademarks including "A Better App Company," "WhatRUHungry4," "FoodSmash," and "Munchzilla" are our property.

Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use our Apps for personal, non-commercial purposes in accordance with these Terms.

User Content

If you create content within our Apps (such as custom wheels in WhatRUHungry4), you retain ownership but grant us a license to use, display, and store that content as necessary to provide the service.

8. Third-Party Services

Yelp (WhatRUHungry4)

Restaurant information is provided by Yelp Fusion API. Your use of this data is subject to Yelp's Terms of Use. We are not responsible for the accuracy of Yelp data.

App Stores

Your use of our Apps is also subject to the terms of Apple App Store or Google Play Store, as applicable.

Advertising

Our free Apps may display advertisements from third-party ad networks. These are subject to their own terms and privacy policies.

9. Privacy

Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimer of Warranties

OUR APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy of information
• Uninterrupted or error-free operation

For WhatRUHungry4 specifically: We do not guarantee the accuracy, completeness, or reliability of restaurant information provided by Yelp. Restaurant availability, hours, menus, and prices may change without notice.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, A BETTER APP COMPANY SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or goodwill
• Any damages exceeding the amount you paid us in the past 12 months (or $100, whichever is greater)

Some jurisdictions do not allow certain limitations, so these may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless A Better App Company, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of our Apps
• Your violation of these Terms
• Your violation of any third-party rights

13. Termination

We may suspend or terminate your access to our Apps at any time, with or without cause, with or without notice. Upon termination:

• Your license to use the Apps ends immediately
• You must stop using the Apps
• We may delete your account and data
• In-app purchases are not refundable

Sections regarding intellectual property, disclaimers, limitations of liability, and indemnification survive termination.

14. Changes to Apps and Terms

App Changes

We may modify, update, or discontinue our Apps or any features at any time without notice. We are not liable for any changes or discontinuation.

Terms Changes

We may update these Terms from time to time. We will notify you of material changes through the Apps or via email. Continued use after changes constitutes acceptance of the updated Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of [Your State], United States, without regard to conflict of law principles.

Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that you may bring claims in small claims court if eligible.

You agree to waive any right to participate in class action lawsuits or class-wide arbitration.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and A Better App Company regarding the use of our Apps.
